Basis and Purpose
These rules are based on the Colorado Open Records Act, Sections 24-72-201 to 24-72-309, C.R.S., specifically the provisions providing protection of records in the custody of the Secretary of State and for the unnecessary interference with the regular discharge of the duties of the Secretary of State’s office.
It is the purpose of these rules is to describe the procedures governing requests for the inspection of public records in the custody of the Secretary of State, in order to ensure the protection of such records and the prevention of unnecessary interference with the regular discharge of the duties of the Colorado Secretary of State’s office. Specifically, the amendment to these rules is in response to questions raised by the Office of Legislative Legal Services in the course of its rule of these rules pursuant to C.R.S. 24-4-103(8)(d).
Specific Statutory Authority
These rules are promulgated in accordance with the Colorado Administrative Procedures Act, C.R.S. 24-4-103, "Rule-making procedure," and pursuant to the specific rule-making authority granted to the Secretary of State as the custodian of records in C.R.S. 24-72-203(1)(a)
