Pursuant to the requirements of section 24-4-103 C.R.S., notice of proposed rulemaking is hereby given by the Secretary of State. A rulemaking hearing will be held on Thursday, November 9, 2006 at 1:30 p.m. in the Secretary of State’s Blue Spruce Conference Room, 1700 Broadway, Denver, Colorado 80290. All interested persons will be afforded the opportunity to be heard on the subject of “Rules Concerning Public Records Requested Pursuant to the Colorado Open Records Act, 8 CCR 1505-12.”
Subject of Proposed Rulemaking
Amendments to the “Rules Concerning Public Records Requested Pursuant to the Colorado Open Records Act, 8 CCR 1505-12”, including but not necessarily limited to repealing or amending Rule 3.6, and concerning the denial of inspection of records in certain circumstances, in response to legal objections made by the Office of Legislative Legal Services.
Authority for Proposed Rulemaking
"Rules Concerning Public Records Requested Pursuant to the Colorado Open Records Act” are proposed pursuant to the following statute:
Section 24-72-203 (1) (a), C.R.S., which authorizes the custodian of any public records to “make rules with reference to the inspection of such records as are reasonably necessary for the protection of such records and the prevention of unnecessary interference with the regular discharge of the duties of the custodian or the custodian’s office”.
Copies of the proposed rules may be obtained on or before November 1, 2006, from the office of the Secretary of State, 1700 Broadway, Suite 250, Denver, Colorado, 80290, or by calling (303) 892-2200 ext. 6108. An initial copy will be given free of charge. The proposed rules also will be published on the Secretary of State’s website at www.sos.state.co.us in the “Information Center”.
The hearing will be held in accordance with section 24-4-103 C.R.S. Written and oral data, comments, and arguments, will be received from all interested parties. Written submissions must be filed at or before the commencement of the hearing on November 9, 2006 at 1:30 p.m. in order to be considered. Oral testimony may be limited, in order to allow the proceedings to go forward with reasonable promptness and efficiency.
