Surety Bond Requirement for Paid Solicitors

Paid solicitors who register or renew their registration with the Colorado Secretary of State will need to attach evidence of a $15,000 surety bond with their filings per §6-16-104.6(3.5), C.R.S. They can do this by attaching the Secretary of State’s surety bond form or a copy of the bond itself, as long as the copy of the bond includes the following information:

  1. The name of the organization or individual covered by the surety bond. This must match the name of the applicant.
  2. The amount is at least $15,000.
  3. The effective dates of the surety bond cover the period for which the solicitor is applying to solicit charitable contributions without any gap in coverage.
  4. The attorney-in-fact has signed the bond or the surety bond form
  5. If an attorney-in-fact has signed the surety bond form, confirm that the Power-of-Attorney is also attached and lists the same attorney-in fact.

All bonds must be renewed annually at the same time as the bondholder's license is renewed. On registration renewals, we will accept a continuation certificate issued by the surety, a copy of the bond, or, as with initial registrations, our registration bond form signed by the attorney-in-fact with a copy of the Power of Attorney.
