Form for Foreign Entity Authority Revised

Effective August 17, 2004, the Business Division has revised its form/cover sheet for Statement of Foreign Entity Authority. The newly revised form adds, as the first required ‘element’, the “ID number (if applicable)”. The purpose of this new element is to allow a foreign entity that had previously had filed a Statement of Foreign Entity Authority, but that had subsequently withdrawn or been administratively revoked, to indicate that a record already exists for the entity, if applicable, and in some cases to indicate that the foreign entity is entitled to use the foreign entity name that it proposes to use in the case in which that name otherwise would not be ‘available’.

The Business Division will continue to process Statements of Foreign Entity Authority delivered on the form/cover sheet in effect prior to August 17, 2004 through August 31, 2004. Commencing September 1, a Statement of Foreign Entity Authority prepared using the ‘old’ form will be rejected in the case in which the proposed foreign entity name is ‘not available’.

The Business Division may revise forms/cover sheets as necessary without notice other than through our Web site. Use of any form that is not obtained currently from our Web site may result in the document being rejected. Please check our Web site regularly for the latest forms.
