Description of Subjects/Issues |
Under 42-5-112 (3) (f), CRS, the CDPS Executive Director is given authority to promulgate rules and regulations concerning the review, approval, and administration of grants issued through CATPA.
During the 2023 Colorado General Assembly, 42-5-112, CRS, was amended by SB 23-257 and it is in response to these amendments an internal review of 8 CCR 1507-50 that amendments are being proposed.
The amendments proposed to 8 CCR 1507-50 are intended to:
1)Respond to the changes introduced into 42-5-112, CRS, through SB 23-257, expanding the scope of the CATPA grant program to include programs supporting victims of automobile theft and automobile theft-related crimes.
2)Respond to other changes introduced into 42-5-112, CRS, through 23-257 affecting funding and the application thereof to programs designed to counteract automobile theft and automobile theft-related crimes.
3)Clarify CATPA Grant Funding initiatives for which grant funding may be available and the guidelines and criteria according to the Board will consider all grant applications received to determine eligibility and award approval.
4)Clarify when approval of funding is final; and
5) Update references to documents and websites cited within the rules and address general grammar, formatting, and verbiage updates throughout. |
Purpose/Objective of Rule |
42-5-112 (1) and (2), CRS, create the Colorado Automobile Theft Prevention Authority (CATPA) in the Colorado Department of Public Safety (CDPS) and the Colorado Automobile Theft Prevention Authority Board responsible for making decisions affecting the administration of CATPA and grants issued thereby.
Under 42-5-112 (3) (f), CRS, the Executive Director of the CDPS is given authority to promulgate rules and regulations applicable to the review, approval, and administration of grants through CATPA consistent with 42-5-112 (3), CRS. These rules are presently codified as 8 CCR 1507-50. During the 2023 Colorado General Assembly Session, 42-5-112, CRS, was amended by SB 23-257. It is in response to this legislation and an internal review of the CATPA rules that amendments are being proposed. The amendments proposed to 8 CCR 1507-50 are intended to:
1)Respond to the changes introduced into 42-5-112, CRS, through SB 23-257 expanding the scope of the CATPA grant program to include programs supporting victims of automobile theft and to promote the enhancement of technology used to counter automobile theft and automobile theft-related crimes.
2)Respond to other changes introduced into 42-5-112, CRS< through 23-257 affecting funding and application thereof to programs designed to counteract automobile theft and automobile theft-related crimes.
3)Clarify CATPA Grant Funding Initiatives for which grant funding may be available and the guidelines and criteria according to the Board will consider all grant applications received to determine eligibility and award approval.
