| Description of Subjects/Issues |
S.B. 23-219, concerning services to support students eligible to enroll in facility schools, directed
CDE’s Office of Facility Schools to assemble stakeholders to analyze and recommend changes to the
methods used for calculating tuition costs for approved facility schools. The legislation also changed
the state funding model for approved facility schools. Based on these statutory changes and
stakeholder recommendations, the department is recommending that the board update its Rules for
the Administration of the Exceptional Children’s Educational Act, 1 CCR 301-8. Additionally, H.B. 23-
1089 requires an amendment to the definition of an administrative unit of residence.
The proposed amendments to the rules would:
• Amend the definition of an administrative unit of residence;
• Amend the definition of an “approved facility school” to include a specialized day school;
• Align with current statute regarding state education funding for facility schools - changing
from Per Pupil Revenue to a baseline funding model;
• Define tuition cost for approved facility schools separately from tuition costs for charter
schools and schools of choice; and
• Describe the new tiered model for tuition rates and annual fiscal reporting requirements
Finally, the State Board will also make miscellaneous minor revisions to administrative procedure. |
