Description of Subjects/Issues The Health Facilities and Emergency Medical Services Division’s (the Division’s) health facility licensing, oversight, and enforcement activities are primarily funded through the collection of fees approved by the Board of Health. The fees paid by facilities licensed by the Division are deposited into different statutorily-created cash funds based on the type of facility paying the fee, (e.g., the General Licensure Cash Fund, the Assisted Living Residence Cash Fund, or the Home Care Agency Cash Fund). The Division has made every effort to manage the shortfalls through a combination of efforts, including spending down fund balances, leaving positions unfilled, and redirecting General Fund support wherever possible. However, these efforts are not sustainable, nor are they able to fill the growing gap between fee revenues and the cost of doing business. Those funds are then appropriated by the legislature to the Division for its licensure and oversight activities. The Division is now proposing CPI-based fee increases to take effect July 1, 2024.
