Description of Subjects/Issues |
Rule 1: The purpose of this rule is to establish the scope of the rules. The purpose of the proposed amendment is to take out repealed statute §39-21-122, C.R.S. and replace it with the correct statute §39-21-112, C.R.S. Additionally, there is a proposed amendment to Rule 1 (A) and the purpose of the proposed amendment is to take out the following overbroad and confusing statement: “Except as otherwise ordered by the Hearing Officer and except as excluded below…”
Rule 3: The purpose of this rule is to establish the hearing process for hearings before the Hearings Division involving non driver’s license related matters. The purpose of the proposed amendments to Rule 3 is to address issues related to provisions that conflict with statute or have no statutory authority to support them. Specifically Rule 3.6 is being deleted because it is inconsistent with statutes. Rule 3.10 is being deleted because it is inconsistent with statute. Rule 3.18 is being deleted because there is no statutory authority to support this part of the rule. |
Purpose/Objective of Rule |
Rule 1. The purpose of this rule is to explain and define the scope of the Rules in 1 CCR 211-1, which are limited to non-driver’s license matters including the Regulatory and Taxation cases before the Hearings Division. The purpose of the proposed amendment is to take out repealed statute §39-21-122, C.R.S. and replace it with the correct statute §39-21-112, C.R.S. Additionally, there is a proposed amendment to Rule 1 (A) and the purpose of the proposed amendment is to take out the following overbroad and confusing statement: “Except as otherwise ordered by the Hearing Officer and except as excluded below…”

These revisions are intended to address issues related to provisions that conflict with statute or have no statutory authority to support them. Rule 3.18 is being deleted because there is no statutory authority to support this part of the rule. |
