Description of Subjects/Issues |
Rules for the Division of Conservation. Emergency Rules (chapters 2, 3 & 4) were adopted 12/21/2018. These proposed permanent rules include the three emergency rules plus one new rule consisting only of definitions (chapter 1). Changes to the emergency rules are minor, affecting only chapter 2. They have been red-lined. |

Dear Stakeholder
The Division of Conservation has filed a notice with the Secretary of State for the purpose of adopting permanent rules pursuant to part 11, article 61, title 12 of the Colorado Revised Statutes. These draft rules look very much like the emergency rules adopted by the Division on December 21, 2018, with a new "Definitions" chapter added. In particular, we are proposing to add a new definition of "conservation easement" that will make it clear these Division of Conservation rules pertain only to easements involving a state income tax credit.
To facilitate your review, red-lined drafts of the proposed permanent rules are attached.
Please submit any comments to me by March 15. In addition, the Division will host an in-person stakeholder meeting on Thursday March 21, from 10 AM - noon, on the 19th Floor of 1560 Broadway. |

On March 1, 2019, the Division of Conservation filed this rulemaking notice. It contained the incorrect hearing date. This error was not discovered until after the March 1 notice was published in the Colorado Register, Vol. 42, No. 5, March 10, 2019. The proposed rules were refiled on 3/15/2019, tracking number 2019-00116. |
