Statutory Authority Pursuant to section 40-2-129, C.R.S. and in accord with sections 24-4-101, et seq., 40-1-101, et seq., 40-2-108, 40-3-102, 40-3-103, 40-4-101, and 40-4-108, C.R.S.
Description of Subjects/Issues Rulemaking initiated consistent with HB 13-1292, specifying in evaluating utility requests for a Certificate of Public Convenience and Necessity for construction or expansion of generating facilities, pollution control and fuel conversion projects of existing coal-fired plants, the Commission shall consider, factors that affect employment and the long-term economic viability of Colorado communities.
Comments Supplemental Notice of Proposed Rulemaking continues rulemaking begun with TN 2013-01184. Interested persons may file written comments no later than April 24, 2014, and any pre-filed comments responsive to the initial comments are to be submitted no later than May 1, 2014. The Commission prefers that comments be filed using its E-Filing System at http://www.dora.state.co.us/pls/efi/EFI.homepage.

Reason We find that the record does not support changes proposed by the participants or included in the Recommended Decision, and we set aside the rules proposed in the Recommended Decision. The Commission shall issue a new NOPR to determine what pollution control projects are in the ordinary course of business.
